COD form on product page flagged as checkout bypass — but similar apps are still live. Where is the line?

My app was recently flagged for violating Section 2.3.18 — the reason given was:

“The app allows for the bypass of Shopify checkout, with checkout available directly on the product pages, as a popup or an embedded form.”

I understand the violation. But I’m confused because several other COD form apps on the App Store appear to have the exact same functionality (embedded form on product page, order created via API without going through Shopify checkout URL) and they are still live.

My question is simple: what makes one COD form app compliant and another not?

Is it about having Shopify’s “express written authorization” as mentioned in 2.3.18? If so, how does one apply for that?

Just because others are doing it doesn’t mean they’re compliant too and will no doubt get pulled up on it too.

Those apps have been around for 5 to 6 years and have tens of thousands of users. I feel like it’s a random reminder. More importantly, Shopify is delisted the app.
