Help take down the website selling illegal Shopify themes

Dear Shopify Team!

Not sure if that’s the right channel, but there’s no dedicated to theme piracy yet.
Please help your theme dev community in fighting illegal theme re-selling.

This website is illegally reselling lots of themes from Shopify Theme Store literally for nothing: Download Shopify Theme Store Themes at Best Prices - ThemeShelf

Don’t know where else to ask. Partner support sent me to Shopify Legal, while Shopify legal won’t answer a single email from me for months.

Are one of your themes hosted on this pirated website?

If so, you have the right to issue a DMCA takedown through the website’s registrar.

First, use a WHOIS look up to determine the registrar of that domain. Then you can open the contact area of that registrars website to find their abuse inbox.

Usually it’s abuse@godaddy.com for example.

Then you provide your evidence that this site is hosting content that infringes on your copyright.

You may need to follow up a few times, but the registrar has the authority to take down the site.

Yes, I’ve already done so. But in my experience, that’s a path to nowhere. Last time there was a similar store (bet that’s the same one again), Shopify partner support helped us resolve the issue after multiple tickets from theme partners. But this time they turned me down.

Yes, it can take some time for a registrar to act on your report.

The other avenue to take is to file a complaint about the registrar’s untimely action through ICANN.

ICANN is the oversight board for registrars, and ICANN has the power to revoke their license if they don’t handle abuse properly.

But teh question I wnat to ask is:

  1. Have you been able to solve the issue

  2. Is your theme part of this theme…or teh question should be; where did you get your theme?

Probably ICANN is the solution because the registrar just replied and refused to help, sending me elsewhere.

Mind sharing the registrar’s response?

Are they claiming that your copyright isn’t infringed and instead it’s Shopify’s to claim?

Just curious why they would reject your claim.

Yes hopefully escalating to ICANN corrects their action. Or drafting up a C&D letter may make it more serious.

They provide some further paths to follow, but all in all it sounds like some generic response. I mean, look, it was a forwarded reply!

They’re claiming that the domain isn’t registered with them:

…the domain name holder is not a customer of Realtime Register. Nor are we the domain name registrant.

But a whois lookup says otherwise.

That’s really strange, I’ve never seen that before. I have you tried contacting that abuse@koddos.com email they’ve recommended?
